Terms of Service

CuddleCloud: Mental Wellness ("the app") is provided by CuddleCloud ("CuddleCloud", "we", "us" or "our").

By creating an account or using the app, you agree to these terms. If you do not agree, do not use the app.

These terms replace and expand the short terms shown in the app. They apply together with our Privacy Policy.

You must be at least 13 years old to use CuddleCloud.

If you are under 18, a parent or legal guardian must review and agree to these terms on your behalf.

By creating an account, you confirm that you meet these requirements.

When you create and use your account, please:

• give accurate information and keep it up to date
• keep your password confidential
• tell us straight away at cuddlecloud61@gmail.com if you think someone has used your account without your permission

You are responsible for activity on your account.

In particular:

• The assessments (PHQ-9, GAD-7 and PSS-10) are screening questionnaires. Their results are not a diagnosis.
• Pulse readings are for personal tracking, not medical monitoring.
• Period and fertile window predictions are estimates. Never use them as contraception or to make medical decisions.
• Other members are not health professionals, and what they share in chat is not medical advice.

Our Privacy Policy explains what information we collect, how we use it, who can see it and the choices you have. Please read it alongside these terms.

You own what you create in CuddleCloud, including journal entries, notes and chat messages.

You give us a limited, non-exclusive licence to store, process and display your content only to provide the service, for example to deliver your messages to the people you chat with.

When you delete your account, your chat messages are erased and show to others as "Message not available" from "Deleted User".

Please only post content that you have the right to share.

Chat is a shared, supportive space. When you use it, you agree to follow our community guidelines:

1. Be kind, respectful and supportive to everyone.
2. Keep personal information private. Never share others' details.
3. No hate speech, bullying or harmful content of any kind.
4. Use the flag to report content that breaks the guidelines.
5. Conversations are moderated to keep everyone safe and supported. Moderators review reports and can warn or deactivate accounts that break the rules.

We have no tolerance for objectionable content or abusive behaviour. When you use CuddleCloud, you must not:

• use the app for anything unlawful
• harass, bully or threaten anyone, or post hate speech
• post or share sexual content involving minors. We have zero tolerance for this and report it to the authorities
• encourage or promote self harm
• send spam, advertise or solicit
• impersonate anyone
• share other people's personal information
• try to access other people's accounts or our systems
• reverse engineer, decompile or tamper with the app
• use bots, scripts or scraping
• interfere with or disrupt the service

• Members can report any message using the flag.
• Moderators review reports and may remove content, send warnings that appear in the app, or deactivate accounts.
• We do not monitor every conversation in real time, so please use the flag whenever you see something that breaks the guidelines.
• We may share serious threats to someone's safety with the authorities.

• Guided videos play through YouTube, under the YouTube Terms of Service.
• Nearby places come from third-party map data and may be incomplete or out of date. Listing a place is not an endorsement, so please check details with the place directly.

We may update, change or remove features, or pause the service for maintenance.

The app, the CuddleCloud name, logo, design and content belong to CuddleCloud. Do not copy or reuse them without our permission.

We give you a personal, non-exclusive, non-transferable and revocable licence to use the app on devices you own or control, for your own non-commercial use, in line with these terms.

Videos, map data and other third-party content belong to their owners.

You can stop using CuddleCloud and delete your account at any time. In the app, go to the Profile tab, scroll to the bottom and tap Delete Account. Deletion is immediate and permanent. If you cannot sign in, email cuddlecloud61@gmail.com from the address on your account.

We may suspend or end your account if you break these terms, or where the law requires it.

Sections 6, 12, 14 and 16 continue to apply after your account ends.

CuddleCloud is provided "as is" and "as available". To the extent the law allows, we do not promise that the app will always be available, uninterrupted or free of errors, and we give no other warranties, whether express or implied.

To the extent the law allows, we are not liable for any indirect or consequential loss, for loss of data, or for loss arising from content posted by other members or from third-party content and services.

Nothing in these terms limits or excludes any liability that cannot be limited or excluded by law, or affects your statutory rights as a consumer.

We may update these terms. When we do, we will change the date at the top of this page, and we will tell you about significant changes in the app or by email.

If you keep using the app after a change, you accept the updated terms. If you do not agree with them, you can stop using the app and delete your account.

These terms are governed by [GOVERNING LAW AND JURISDICTION].

If the consumer laws where you live give you the right to bring a claim in your local courts or under your local law, nothing in these terms takes that right away.

If a court finds that part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.

CuddleCloud is available on Google Play and the Apple App Store. The store you download it from has its own terms, which also apply to you.

Google Play

If you downloaded CuddleCloud from Google Play, the Google Play Terms of Service also apply.

Apple App Store

If you downloaded CuddleCloud from the Apple App Store, the following also applies:

• These terms are between you and CuddleCloud only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
• Your licence to use the app is limited to using it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for addressing any claims by you or any third party about the app or your possession or use of it, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when you use the app, such as your mobile network provider's terms.
• Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
